Former Orange County Sheriff and convicted felon Mike Carona is going back to court to ask an appellate panel to clear his name. Carona will ask a three-judge panel of the 9th Circuit Court of Appeals in Pasadena on Wednesday to reverse his January 2009 conviction for witness tampering. The former sheriff was sentenced to 5 1/2 years in prison for trying to persuade ex-assistant sheriff Don Haidl to lie during a grand jury probe. He was allowed to remain free pending his appeal. Carona's lawyers argue that prosecutors broke an ethical rule when they arranged for Haidl to secretly record an August 2007 conversation despite knowing Carona had retained a criminal defense attorney at the time. The tape was played during trial, despite objections from Carona's attorneys.
